THE SEVENTH AMENDMENT TO DECREE OF THE MINISTER OF FINANCE No. 101/KMK.05/1997
ON CUSTOMS DECLARATION
THE MINISTER OF FINANCE,
Considering:
- a. that following the change in provision on the release of cash money from and to customs areas, based on Registration of Bank Indonesia No. 4/8/PBI/2002 on requirements and procedures for carrying Rupiah banknote from and to the territory of the Republic of Indonesia and Law No. 15/2002 on money laundering crimes as already amended by Law No. 25/2003 as well as in order to avoid misunderstanding in the field with regards to alcoholic drink brought by passengers or crew of transport facilities from outside import Customs Areas, it is necessary to change, the model and content of Import Declaration of Goods belonging to Passengers or Crew of Transport Facilities (BC 2.2) and issue a cash-money carrying form (BC 3.2);
- b. that following the ratification of the economic-cooperation agreement in the framework of ASEAN-China Free Trade Area by Presidential Decree No. 48/2004 and the issuance of Decree of the Minister of Finance No. 355/KMK.01/2004 on stipulation of tariffs of import duty on the import of goods in the framework of the Early Harvest Package (EHP) of ASEAN - China Free Trade Area (FTA) and Decree of the Minister of Finance No. 356/KMK.01/2004 on stipulation of tariffs of import duty on the import of goods in the framework of the Early Harvest Package (EHP) of the Bilateral Indonesia-China Free Trade Area (FTA), it is necessary to supplement code of facilities/fulfillment of impart requirements in Import Declaration "(BC 2.0);
- c. that based on the considerations as meant in letters a and b, a regulation of the Minister of Finance on the Seventh Amendment to Decree of the Minister of Finance No. 101/KMK.05/1007 on customs declaration needs to be stipulated;
in view of :
- 1. Law No. 10/1995 on customs affairs (Statute Book of 1995 No. 75, Supplement to Statute Book No. 3612);
- 2. Law No. 11/1995 on excise affairs (Statute Book of 1995 No. 76, Supplement to Statute Book No. 3613);
- 3. Law No. 15/2002 on money laundering crime (Statute Book of 2002 No. 30, Supplement to Statute Book No. 4191) as already amended by Law No. 25/2003 (Statute Book of 2003 No. 18, Supplement to Statute Book No. 4324);
- 4. Government Regulation No. 71/2001 on revocation of Government Regulation No. 18/1998 concerning the release or import of Rupiah banknote from or into the Indonesian Customs Area (Statute Book of 2001 No. 129);
- 5. Presidential Decree No. 187/M/2004 ;
- 6. Decree of the Minister of Finance No. 101/KMK.05/1997 on customs declaration as already amended several times and the latest by Decree of the Minister of Finance No. 230/KMK.04/2004;
- 7. Decree of the Minister of Finance No. 355/KMK.01/2004 on stipulation of tariffs of import duty on the import of goods in the framework of the Early Harvest Package (EHP) of ASEAN - China Free Trade Area (FTA);
- 8. Decree of the Minister of Finance No. 356/KMK.01/2004 on stipulation of tariffs of import duty on the import of goods in the framework of the Early Harvest Package (EHP) of the Bilateral Indonesia-China Free Trade Area (FTA);
Observing :
Regulation of Bank Indonesia No. 4/8/PBI/2004 on requirements and procedures for carrying Rupiah banknote from or to the territory of the Republic of Indonesia;
DECIDES :
To stipulate :
THE REGULATION OF THE MINISTER OF FINANCE ON THE SEVENTH AMENDMENT TO DECREE OF THE MINISTER OF FINANCE NO. 101/KMK.05/1997 ON CUSTOMS DECLARATION.
Article 1
Several provisions in Decree of the Minister of Finance No. 101/KMK.OS/1007 on customs declaration shall be amended as follows:
The provision in Article 3 is supplemented by one point, namely point n so that the article entirely reads as follows:
"Article 3
The customs declarations as meant in Article 1 shall include:
- a. Declaration of the Plan for Arrival of Transport Facilities (BC 1.0);
- b. Declaration of Arrival/Departure of Transport Facilities (BC 1.1);
- c. Declaration of Imported Goods carried further (BC 1.2);
- d. Declaration of Transport of Goods Originating from Customs Area from One Place to Another Place through outside Customs Area (BC 1.3);
- e. Import Declaration of Goods (BC 2.0);
- f. Import Declaration of Certain Goods (BC 2.1);
- g. Import Declaration of Goods Belonging to Passengers or Crew of Transport Facilities (BC 2.2);
- h. Declaration of Import of Imported Goods to Bonded Collection Place (BC 3.0);
- i. Export Declaration of Goods (BC 3.0);
- j. Export Declaration of Certain Goods (BC 3.1);
- k. Declaration of Import of Goods Originating from Customs Area to Bonded Zone (BC 4.0);
- l. Declaration of Settlement of Imported Goods Exempted from Import Duty and/or Excise as well not subjected to Value Added Tax and Sales Tax on Luxury Goods (BC 2.4);
- m. Declaration of Release of Goods from Bonded Collection Place (BC 2.5);
- n. Declaration of Carrying of Cash Money to outside Customs Area (BC 3.2)."
2. To supplement code of facilities/fulfillment of import requirements in point 19 of Attachment III to Decree of the Minister of Finance No. 101/KMK.05/1997 as already amended by Decree of the Minister of Finance No. 447/KMK.05/2000, namely:
- 54 ASEAN-China FTA and Bilateral Indonesia - China FTA
3. To amend Attachment VII of Decree of the Minister of Finance No. 101/KMK.05/1997 as already amended by Decree of the Minister of Finance No. 452/KMK.04/2001 so as to be stipulated in Attachment I to this regulation.
4. To supplement a new attachment, as Attachment XIV to Decree of the Minister of Finance No. 101/KMK.05/1997 as stipulated in Attachment III to this regulation.
Article 2
The regulation shall come into force as from January 1, 2005.
For public cognizance, the regulation shall be announced by placing it in State Gazette of the Republic of Indonesia.
